This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…to issue an appropriate writ more particularly in the nature of Writ of mandamus to declare the action of the respondents in proposing / proceeding to dispossess the petitioner from her lands upto an extent of Ac. 0.01 ½ cents in Sy.
No. 132, Y.S.R. Jagananna Colony, Kondepalle Village, Gangadhara Nellore Mandal, Chittoor District, without initiating any resumption proceedings or issuance of any notice is as per se illegal, manifestly arbitrary, unreasonable, irrational, perverse, unfair, biased, preposterous, whimsical, capricious, unconscionable, unconstitutional besides being violative of principles of natural justice besides being opposed to the very spirit and object of justice and fair play and fundamental rights guaranteed under Article 14, 19, 21 and 300-A of the Constitution of India and for a consequential direction not to interfere with the peaceful possession of the petitioner over the said land and to pass such other order or orders ….”
2. The case of the writ petitioner, briefly stated, is as follows:
The petitioner is a landless poor person and was allotted a house site patta vide Patta No. CTR00171057 under the “Navaratnalu – Pedalandariki Illu” scheme and since the date of allotment, the petitioner had been in possession and enjoyment of the said house site. 4 BSB, J W.P.No.16370 of 2026 While so, the respondents are threatening the petitioner to dispossess from the subject land. Hence, this writ petition was filed. 3. The learned Assistant Government Pleader for Revenue placed on record a copy of the written instructions vide Roc. No. A/137/2026, dated 24.06.2026, wherein, it was stated, briefly, as follows: (i) The land in Sy.No.132/1 admeasuring Ac.1.30 cents and Sy.No.132/2 admeasuring Ac.0.43 cents is classified as “G.D.” land as per the “A” Register of Kondepalli Village, G.D. Nellore Mandal. (ii) The petitioner has made plinth level construction in an extent of Ac.0.0 ½ cents in Sy.No.132 of Kondepalli Village, G.D. Nellore Mandal. (iii) The allegation of the writ petitioner that the respondents are seeking to acquire the subject land for developmental activities, as stated in the affidavit, is false and incorrect. In fact, the respondents have neither interfered with nor disturbed the petitioner’s construction of house in the said extent of Ac.0.0 ½ cents in Sy.No.132.
Further, the said land was not proposed for any developmental activities by the respondents as alleged in the petition.”
4. The learned counsel for the petitioner requested to dispose of the writ petition recording the above stated written instructions submitted by the learned Assistant Government Pleader. 5 BSB, J W.P.No.16370 of 2026
5. Accordingly, the Writ Petition is disposed of recording the aforesaid written instructions. There shall be no order as to costs.
