Accused in S.C.No.1157/2026 pending before the Court of XLV Addl. City Civil & Sessions Judge, Bengaluru arising out of Crime No.189 of 2026 registered by Chandra layout Police Station, Bengaluru City for offences punishable under Section 75(2) of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.189 of 2026 was registered by Chandra Layout Police Station, Bengaluru City for offence punishable under Section 75 of BNS, 2023 against petitioner herein, based on first information dated 12.05.2026 received from the victim girl, aged 19 years. During the course of investigation of the present case, petitioner was arrested on 12.05.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.7272/2026 was rejected on 05.08.2026. FIR in the present case was registered for offence punishable under Section 75 of BNS, 2023 against petitioner herein, based on first information dated 12.05.2026 received from the victim girl, aged 19 years. Investigation of the case is now completed and the charge sheet is filed. A reading of the charge sheet material would go to show that,. victim girl is the daughter of CW2. After the death of the father of the victim, CW2 had married petitioner on 24.05.2022. After marriage, CW2 and the victim girl were staying in the house of petitioner. 5. Allegation against the petitioner is that he has misbehaved with the victim girl and also had touched her chest inappropriately. It is under these circumstances, he has been now charge sheeted for offence punishable under Section 75(2) of BNS, 2023. Considering the nature of allegations found against petitioner and the maximum punishment provided for the alleged offences, the following:- ORDER (i) Criminal petition is allowed. (ii) The petitioner is directed to be enlarged on bail in S.C.No.1157/2026 pending before the Court of XLV - 4 - HC-KAR CNR: KAHC010645972026 NC: 2026:KHC:51756 CRL.P No. 14315 of 2026 Addl. City Civil & Sessions Judge, Bengaluru arising out of Crime No.189 of 2026 registered by Chandra layout Police Station, Bengaluru City for offences punishable under Section 75(2) of BNS, 2023, subject to the following conditions:- a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future.
