The petitioners are seeking pre-arrest bail in connection with C.T. Case No.479 of 2020 arising out of Karanjia P.S. Case no.169 of 2020 for commission of offences under Sections 498-A/379/506/307/34 of I.P.C. pending in the Court of the learned S.D.J.M., Karanjia. 3. The prosecution case, in brief, is that on 07.09.2020, the informant lodged a report before the I.I.C., Karanjia Police Station, inter alia, alleging that she had married one Manis Lal on 09.06.2011 in accordance with their caste and customary rites. At the p. 2 time of marriage, her father is stated to have paid a sum of Rs.3,50,000/- along with other household articles as per the demands of the in-laws. Out of the said wedlock, a female child was born in the year 2013. It is alleged that thereafter, the present petitioners along with other family members subjected her to physical and mental cruelty in connection with further demands for dowry. On 11.07.2020, her husband allegedly assaulted her and attempted to kill her by opening the gas cylinder, as a result of which she sustained burn injuries on different parts of her body and was subsequently hospitalized by her uncle and aunt. It is further stated that the matter was later settled between the parties. Subsequently, on 10.08.2020, when her brother came to her matrimonial home to take her to her parental house, the present petitioners allegedly objected. It is further alleged that on 05.09.2020, her husband along with the petitioners came to her parental house, where they abused and assaulted her. Hence, this case. Page 3 of 4 4. The petitioners are the in-laws of the informant. The F.I.R. has been registered on 07.09.2020. After investigation, charge-sheet has been filed on 29.03.2021 for the alleged commission of offences under Sections 498-A/379/506/307/34 of I.P.C. 5. Since the dispute is essentially arising out of the matrimonial discord and F.I.R. was registered way back in the year 2020, charge-sheet has already been filed in the present case, therefore, the apprehension of the petitioners sounds to be genuine. Hence, the application deserves merit. Accordingly, it is directed that in the event, the petitioners surrenders before the Court in seisin over the matter on or before 10.05.2026 and moves an application for bail, the Court in seisin over the matter shall release them on bail in connection with the aforesaid case on such terms and conditions as it may deem just and proper in the facts and circumstances of the case, but subject to the condition that they shall not indulge in similar criminal offences while on bail; they shall appear before the trial court on p. 4 each and every date of posting.
