The petitioner is apprehending his arrest in connection with NDPS Case No.127 of 2024 arising out of NCB Crime No.08/NCB/Ranchi/2024, for offence registered under section 8(c), 15(c), 25 and 29 of NDPS Act, pending in court of learned Judicial Commissioner cum Special Judge, Ranchi. 3. Learned counsel for petitioner submits that the name of the petitioner has come on confessional statement and the petitioner is neither owner nor driver of the truck in question wherein the allegations are made that 4348.8 kg poppy straw was loaded on the said vehicle. 4. Learned counsel for the respondent NCB opposes the prayer and submits that she has got instruction that notice under section 35(3) of BNS, 2023 was given to the petitioner and the petitioner 2026:JHHC:2294 2 has not replied to the same. She further submits that respondent NCB has found that the petitioner was also involved in supplying the contraband with other accused. 5. In view of the above and considering that the quantity of the contraband was 4348.8 kg and the allegations are there against the petitioner that he was accomplice to other accused, and as such, I am not inclined to grant anticipatory bail to the petitioner, and hence, A.B.A. No.462 of 2026 is, hereby, dismissed.
