23.09.2026 D/L. 45 Ct No. 550 (Naba) WPCRC 171 of 2023 in WPA 13896 of 2013
Nilotpal Sarkar Vs. Sharmi Biswas & Anr.
Mr. Ranajoy Chatterjee, Ms. Riya Mahanta ...for the Petitioner
Ms. Aparna Banerjee ...for the Alleged Contemnors
1. It is brought to the notice of this Court that on the last order dated 17.09.2026, the name of the learned advocate for the alleged contemnors was wrongly typed as ‘Ms. Aparna Saha’. The same should be ‘Ms. Aparna Banerjee’.
2. Learned advocate for the alleged contemnors, Ms. Aparna Banerjee, submits that as per direction of this Court, the petitioner joined the post of Para Teacher in Natidanga Amiya Smriti Vidyalaya (H.S.) on 21.09.2026. In this regard, she has filed a report from the District Education Officer.
3. Learned advocate for the petitioner, Mr. Ranajoy Chatterjee, has submitted that it is correct that the petitioner joined as Para Teacher on 21.09.2026 in the aforesaid school. However, after passing of the order dated 16.05.2013 in W.P. No. 13896 (W) of 2013, he went to join the school but

he was not allowed to join as Para Teacher. He has drawn the attention of this Court to a letter dated 24.03.2015 addressed to Tapas Bandopadhyay, District Project Officer, Sarva Siksha Mission, Nadia, Krishnagar, Dist. – Nadia.
4. Learned advocate for the alleged contemnors, Ms. Banerjee, has submitted that no such letter was received by the District Education Officer as alleged. The petitioner was never restricted from the side of the office of the alleged contemnors to join the post of the Para Teacher.
5. However, as the relevant order dated 16.05.2013 passed in W.P. No. 13896 (W) of 2013 is complied with, there is no need for keeping this contempt proceeding pending.
6. Hence, WPCRC 171 of 2023 stands disposed of. Interim order, if any, stands vacated.
7. Liberty is given to the petitioner to take appropriate steps in accordance with law so far as regards his contention mentioned in para 3 of this order, if law permits him to do so.
