The petitioner claims benefits to the Notification issued by the Ministry of Home Affairs. A reference has been made to the Immigration and Foreigners (Exemption) Order, 2025. I have taken into account the same. The petitioner do not disown to be a national of another country but submits that subsequently by virtue of the Notification he has been compelled to enter India. Be that as it may, the petitioner has relied upon certain documents. However, such documents be first 2 considered by the learned Magistrate. To that effect, the Investigating Officer will conduct an enquiry and submit a report before the learned Magistrate within a period of 45 days. The learned Magistrate would assess the veracity of the report, thereafter, pass orders in an application for bail, if any, in accordance with law. Having considered the overall circumstances, at this stage, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (M) 2132 of 2026 is dismissed. Pending application(s), if any, is also disposed of.
