Learned advocate appearing for the petitioners submit that although the recovery in the present case is 42.760 kgs of ganja but so far as the vehicle which was boarded by the present petitioners, from there 18.2 kgs of ganja were recovered. As such, petitioner is entitled to get the benefit of intermediate quantity. Learned advocate appearing for the State opposes the prayer for bail and submits that rigors of Section 37 of the NDPS Act is attracted. I have taken into account the overall circumstances and I am of the view that as charge-sheet has been submitted very recently, petitioners would better be advised to approach this Court after the independent seizure list witnesses being CSW3 and CSW6 are examined.
2 With the aforesaid observations, at this stage, prayer for bail of the petitioner in CRM (NDPS) 1986 of 2026 is dismissed. Learned trial Court would within a week from the next date fixed overcome the state of consideration of charges and put in efforts so that within four months from the said date the evidence of the aforesaid witnesses are over. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
