1. None appears on behalf of the petitioner.
2. Status report filed by the State furnished by Inspector-In- Charge, Gazole Police Station, Malda dated 15th September, 2026 is taken on record.
3. This revisional application is filed challenging the order dated 14th December, 2010 passed by the learned Judge, Special 1st Court, Malda in connection with Spl. Case No.21 of 2008 arising out of Gazole Police Station Case No.38 of 2000 dated 28th February, 2000 under Section 409 of the Indian Penal Code (in short ‘IPC’), 1860 pending before the learned Judge, Special 1st Court, Malda.
4. By order under challenge dated 14th December, 2010 the learned trial court framed charges against the petitioner and one other under Section 409 read with Section 34 of the IPC. Being aggrieved by and dissatisfied with such
order, the petitioner has preferred the present revisional application.
5. It appears from the status report that the proceeding being Spl. Case No.21 of 2008 under Section 409 read
with Section 34 IPC against the petitioner has been
disposed of and the petitioner, Nemai Ratan Ghosh has been acquitted from the case. In such conspectus, nothing remains to be decided in the present revisional application.
6. Accordingly, the revisional application being CRR 499 of 2011 is disposed of.
7. Interim order, if any, stands vacated.
9. All connected applications, if any, stand disposed of.
10. There shall be no order as to costs.
11. All concerned parties shall act in terms of the copy of the
order duly downloaded from the official website of this Court.
12. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
