Sri.Nataraja Balla A., counsel for the petitioner, Sri.Rakshith Kumar, counsel for respondent No.2 and Sri.Yogesh D.Naik., Additional Government Advocate for respondent No.1 appeared in person. 2. This petition is filed seeking certain reliefs: (i) Issue a writ of certiorari to quash the order dated 29.06.2024 in dispute No.JRM/DDS/01/2022-23 passed by the respondent No.1 (Annexure-A);

(ii) Issue a writ of mandamus directing the respondent No.1 to hold the proceedings in dispute No.JRM/DDS/01/2022-23 at Mysuru; (iii) Award costs of this proceedings; (iv) Pass such other order or orders as this Hon'ble Court deems fit in the facts and circumstances of this case in the interest of justice. 3. Counsel appearing for the respective parties have advanced their respective submissions. Counsel for the petitioner submits that the petitioner has been dismissed from service and that the proceedings are being conducted before the office of the second respondent. Hence, the petitioner has initiated the proceedings at Mysuru.
Counsel appearing for respondent No.2 submits that the officials are finding it difficult to travel from Mangaluru to Mysuru and, therefore, submits that, if the proceedings are transferred from Mysuru to the Mangaluru Camp, the officials would be in a position to extend their cooperation for the speedy disposal of the proceedings. Counsel for the petitioner submits that he has no objection to the proceedings being transferred from Mysuru to

Mangaluru Camp, provided that the proceedings are not conducted in the premises of respondent No.2. 4. The submissions made on behalf of the respective parties are placed on record. 5. The grievance of the petitioner is that, pursuant to his dismissal from service, an appeal has been preferred at Mysuru and the proceedings therein are presently pending. Having regard to the fact that the proceedings were initiated at Mysuru, and taking note of the fact that both the petitioner and the officials of respondent No.2 are residents of Mangaluru, this Court deems it appropriate to transfer the proceedings to Mangaluru Camp. Accordingly, the proceedings pending at Mysuru are transferred to Mangaluru Camp. It is made clear that the proceedings shall be conducted at the DRCS Office, Mangaluru, and not in the premises of respondent No.2. Since the petitioner and respondent No.2 are represented by their respective counsel, they are directed to appear before

the Mangaluru Camp without awaiting any further notice. The petitioner and officials of respondent No.2 shall extend their cooperation for the speedy disposal of the proceedings. 6. With the above observations and directions, the petition stands disposed of. Sd/- (JYOTI M) JUDGE
