(2) Since common questions of fact and law are involved in these writ petitions, therefore, these are being heard and decided together by this common judgment and order. However, for brevity, facts of WPSS No. 2078 of 2024 alone are being considered and discussed here. (3) Irshad Ahmed was initially discharging duties as Beldwar in Muster Roll Establishment of U.P. Irrigation Department and he was thereafter appointed in Work- Charged Establishment of the Department vide order dated 28.7.1997. According to him, his services were regularised on the post of Sheenchpal, vide order dated 26.8.2008. According to petitioner, services rendered by him in Work-Charged Establishment have to be counted towards pension and other benefits. In support of that contention, he relies upon a judgment rendered by coordinate Bench of this Court in WPSS No. 399 of 2018. Learned Counsel for the petitioners submits that since the issue is covered by the said judgment, therefore, these writ petitions deserve to be decided in terms of the judgment rendered in WPSS No. 399 of 2018. 2026:UHC:1858 (4) Mr. Ishwari Datt Paliwal, Additional CSC for the State of U.P., appearing for respondents concedes that the issue involved herein is identical to the one decided in WPSS No. 399 of 2018. He, therefore, submits that these writ petitions can be decided in terms of the said judgment. (5) Writ petitions are, accordingly, decided in terms of the judgment dated 9.3.2018, rendered in WPSS No. 399 of 2018. Competent authority shall examine the claim of petitioners for pension and pass necessary order, as per law, within eight weeks from the date of presentation of certified copy of this order.
