The instant bail application has been filed under Section 483 and 484 of the B.N.S.S., 2023 for grant of regular bail, in connection with Telaiya P.S. Case No.90 of 2025, corresponding to G.R. No.96 of 2026, registered for the offence under Sections 303(2) of the B.N.S., which is pending in the Court of the learned A.C.J.M., Koderma. 2. It has been contended on behalf of the petitioner that it is a case wherein it has been alleged that stolen motorcycle has been recovered from the possession of the petitioner in Bihar in connection with Excise Case bearing Sirdala P.S. Case No.110 of 2025. 3. Learned counsel for the petitioner has submitted that the petitioner is languishing in judicial custody since 05.12.2025. 4. It has further been contended that the charge-sheet has already been submitted and as such, it is a fit case for grant of regular bail. 5. On the other hand, learned A.P.P. appearing for the Opp. Party- State has vehemently opposed the prayer for regular bail. 6. This Court, has considered the imputation made against the petitioner about the fact of recovered motorcycle from the possession of the petitioner in connection with excise case bearing Sirdala P.S. Case No.110 of 2025. 7. This Court, therefore, considering the period of custody as also 2026:JHHC:8471 2 considering the fact that the charge-sheet has already been submitted, is of the view that the present application deserves to be allowed. 8. Accordingly, the instant bail application stands allowed. 9. In consequence thereof, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Koderma, in connection with Telaiya P.S. Case No.90 of 2025, corresponding to G.R. No.96 of 2026 with the condition that the petitioner shall co-operate in the trial and shall not absent himself on the date fixed without any cogent cause.
