September 23, 2026 (47) ARDR WPA 17450 of 2026 Manjubala Mahata Vs. The State of West Bengal & ors. Adv. Arunava Pati, Adv. Arup Kundu, Adv. Sasthi Charan Dhara, Adv. Amitabha Bhattacharyya …for the petitioner. Adv. Bibhasaditya Chakraborty, Adv. Akash Adak, …for the State. Report submitted by the State is taken on record. The Block Development Officer, Raipur has stated that no service record of the petitioner’s husband can be traced. It appears from the letters issued by the Pradhan, Raipur Gram Panchayat that the documents pertaining to the service of the petitioner’s husband have been sent to the Block Development Officer by the Pradhan in 2016. It is most unfortunate that the said employee has retired in 1997 and has expired in 2018 despite which the concerned authority has withheld his retiral benefits. In view of the fact that the entire documents pertaining to the service of the employee have been sent to the Block Development Officer, Raipur, the said authority, being the 5th respondent herein, is directed to disburse the retiral dues of the employee alongwith eight per cent interest per annum thereon within eight weeks from the date of communication of this order. The said authority is also directed to initiate family pension of the petitioner within the said time subject to the petitioner complying with all requisite formalities. The interest on the retiral 2 benefits shall accrue from the date of retirement of the employee till payment of the said amount. The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
