JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.2 in Crime No.211 of 2026 registered by Sampigehalli Police Station, Bengaluru City for the offence punishable under Section 311 of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.211 of 2026 registered by Sampigehalli Police Station, Bengaluru City for the aforesaid offence against unknown two persons, based on the first information dated 17.06.2026 received from Krishna Swamy, who is the alleged victim in the present case. During the course of investigation, the petitioner was arrested on 18.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions - 3 - HC-KAR CNR: KAHC010567742026 NC: 2026:KHC:51365 CRL.P No. 12582 of 2026 Court in Crl.Misc.No.6376 of 2026 was rejected on 23.07.2026. Therefore, he is before this Court. 4. First informant had approached the police on 17.06.2026 at about 10.30 a.m., alleging that on the said date at about 4.30 a.m., when he was near the milk dairy in which he is working as a watchman, two persons who came on a scooter allegedly threatened him with deadly weapons and snatched a sum of Rs.9,000/-, which he had kept in his pant pocket and escaped from the spot. It is in this background, FIR was registered against unknown two persons for the aforesaid offences. During the course of the investigation, accused Nos.1 and 2 were arrested on 18.06.2026 and remanded to judicial custody. Investigation of the case is now completed and charge sheet is filed. 5. It is not in dispute that the petitioner herein, who is arraigned as accused No.2 in the charge sheet, has no other criminal antecedents. Police have recovered the - 4 - HC-KAR CNR: KAHC010567742026 NC: 2026:KHC:51365 CRL.P No. 12582 of 2026 money, after the accused Nos.1 and 2 were arrested. The alleged offence is not punishable with death or life imprisonment. 6. Considering the nature of allegation found against the petitioner, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following : O R D E R (i) The Criminal Petition is allowed. (ii) The petitioner is directed to be enlarged on bail in Crime No.211 of 2026 registered by Sampigehalli Police Station, Bengaluru City for the offence punishable under Section 311 of BNS, 2023, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two - 5 - HC-KAR CNR: KAHC010567742026 NC: 2026:KHC:51365 CRL.P No. 12582 of 2026 sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future.
