The petitioner has approached this Court seeking to quash the notice dated 16.11.2023, issued by the Assistant Conservator of Forests (respondent No.2). By the impugned notice, the petitioner was directed to appear before the authority on 28.11.2023. 3. The notice was issued under Section 64(A) of the Karnataka Forest Act, 1963 (‘the Act’ for short). The petitioner claims that she is the absolute owner in exclusive possession of the agricultural land bearing Sy.No.119 measuring 2 acres and Sy.No.110/8 measuring 2 acres 10 guntas situated at Kottiganahalli Village, Utturu Hobli, Kolar Taluk, Kolar District (schedule properties). It is also seen from the records that, pursuant to the notice issued by respondent No.2, the petitioner submitted a representation dated 28.11.2023, put forth the entire details about the nature of acquisition of the schedule properties. 5. Learned AGA appearing for the respondents-State fairly submits that, no final order is passed yet and before passing any order, by the authority, the representation so submitted by the petitioner would be duly considered by the authorities. 6. In light of the aforesaid submission, the petition is disposed of, with an observation that the respondents-State are bound by the submission that the representation of the petitioner would be considered before passing any order pursuant to the impugned notice dated 16.11.2023. 7.
