JUSTICE E.S. INDIRESH ORAL ORDER In this petition, petitioners are challenging the order dated 08th July, 2025 (Annexure-A) passed by the respondent No.2-Deputy Commissioner in Case No.RP/260/2025 and order dated 14th October, 2024 (Annexure-C) passed by the respondent No.3-Assistant Commissioner in Case No.R.A(YLK):68/2024. 2. Kanal, learned counsel appearing for the respondent No.5; and Sri. P.N. Manmohan, learned counsel on behalf of Sri. Arun J. Birje, appearing for the respondent No.6. 3. Having heard the learned counsel appearing for the parties, on careful perusal of the impugned orders passed by the respondent-Authorities, it is forthcoming that the respondents 5 and 6 are claming right over the subject land - 4 - HC-KAR CNR: KAHC010114972026 NC: 2026:KHC:51965 WP NO.5434 OF 2026 based on the order of grant dated 02nd September, 1962 passed by the Special Deputy Commissioner for Inam Abolition in Case No.44/1959-60, wherein 2 acres of land in Survey No.138/3 of Hunasamaranahalli Village, Yelahanka Taluk was granted in favour of Pillamma W/o Hanumappa. On the other hand, the petitioners are also claming right over the same based on the grant order made in their favour. On perusal of the impugned orders passed by the respondent-Authorities, the same would indicate that, there is a dispute pertaining to boundary of subject land. Therefore, I am of the view that the petitioners have to establish their right over the subject land before the competent Civil Court in a manner known to law. In that view of the matter, no interference be called for in this petition. Accordingly, writ petition is dismissed. SD/- (E.S. INDIRESH) JUDGE ARK List No.: 1 Sl No.: 65
