1. In the instant matter, after advancing arguments for a while,
learned counsel for the respondents raised preliminary objection regarding the maintainability of the present writ petition. It is contended that there exists an arbitration clause under Clause 19.1 of the governing agreement executed inter se the parties.
2. In light of above, this Court deems it fit to dispose of the present writ petition with a direction to the petitioner to avail the
[2026:RJ-JP:14614] (3 of 3) [CW-12672/2025] efficacious and alternate statutory remedy available as per the provisions enshrined under the Arbitration and Conciliation Act,
1996.
3. Accordingly, the present petition stands disposed of. Pending application(s), if any, shall also stand(s) disposed of.
4. It is made clear that the disposal of the present writ petition shall not prejudice the case of either of the parties on merits before the appropriate forum.
