Heard the learned counsel for the petitioner.
2. Learned High Court Government Pleader accepts notice for the first respondent.
3. It is submitted that the first proviso to Section 223(1) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘the BNSS’) is not complied with, before passing the order.

4. It is also submitted that, there are no materials to proceed further, since it is urged that the impugned order is passed in violation of Section 223 of the BNSS.
5. The petitioner is at liberty to approach the jurisdictional Sessions Court urging his contentions.
6. Hence, the petition is disposed.
7. The time spent in prosecuting the present petition from 20.08.2026, till date, shall be excluded in computing the limitation.
8. Registry shall return all the documents to the petitioner after retaining a photocopy of the same.
9. This Court has not expressed anything on the merit of the matter.
10. All contentions shall be urged before the jurisdictional Sessions Court.
