Accused in Crime No.340/2026 registered Bagalagunte Police Station, Bengaluru City, for the offences punishable under Sections 69, 115(2) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.340/2026 was registered by Bagalagunte Police Station, Bengaluru City, for the aforesaid offences against the petitioner herein based on the first information dated 16.07.2026 received from the victim lady aged 22 years. In the said case, petitioner was arrested on 16.07.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.7352/2026 was dismissed on 20.08.2026. Therefore, petitioner is before this Court. 4. A reading of the first information would reveal that the victim lady was married to one Ambarish on 28.12.2023. Subsequently, the said marriage was dissolved by a decree of - 3 - HC-KAR CNR: KAHC010617722026 NC: 2026:KHC:51888 CRL.P No. 13868 of 2026 divorce and the victim lady was allegedly working at Bengaluru in a car showroom. She has alleged that while she was working in the car showroom, she got acquainted to the petitioner who was also working in the very same car showroom. She has stated that subsequently, they started loving each other and the petitioner on the promise of marrying her, had taken her out and had sexual intercourse with her multiple times. Subsequently, he had refused to marry her and informed her that he is already married. It is under these circumstances, FIR was registered against the petitioner for the aforesaid offences. 5. Petitioner who has no other criminal antecedents, is in custody in the present case from 16.07.2026. Investigation of the case is now completed and charge sheet is filed. Petitioner is a married man having wife and a child. The alleged victim is a divorcee and she and the petitioner were working together in a car showroom. She has stated that she and the petitioner loved each other and the allegation against the petitioner is that he had promised to marry the victim lady and had sexual intercourse with her. Considering the aforesaid aspects and the nature of allegations found in the charge sheet which is now - 4 - HC-KAR CNR: KAHC010617722026 NC: 2026:KHC:51888 CRL.P No. 13868 of 2026 filed against the petitioner, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.340/2026 registered Bagalagunte Police Station, Bengaluru City, for the offences punishable under Sections 69, 115(2) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; - 5 - HC-KAR CNR: KAHC010617722026 NC: 2026:KHC:51888 CRL.P No. 13868 of 2026 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
