This first bail application has been moved by the applicant seeking regular bail in Case Crime No.26 of 2025, under Section 103(1), 238, 61(2) of B.N.S., registered at P.S. SIIDCUL, District Haridwar. 3. Learned counsel for the applicant submits that applicant has falsely been implicated in the instant crime and is languishing in jail since 15.01.2025. It is contended by learned counsel for the applicant that co-accused, namely, Ankush and Sachin have already been enlarged on bail by this Court in BA1 No.1074 of 2025 vide order dated 28.11.2025. He submits that this is a case of parity and in case, the applicant is granted bail, he will not misuse the same and will furnish the bail surety as per the satisfaction of this Court. 4. Learned State Counsel has vehemently opposed the prayer for bail. 5. Having regard to the fact that the co-accused, namely Ankush and Sachin, have already been enlarged on bail by this Court in BA1 No. 1074 of 2025, and without expressing any opinion on the merits of the case, this Court is of the 2026:UHC:1228 considered view that the present applicant is also entitled to be released on bail at this stage on the ground of parity. 6. The bail application is allowed. 7. Let the applicant, namely, Jony @ Anant be released on bail, on executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
