Verma, APP ------ 2/15.01.2026 Heard learned counsel appearing on behalf of Petitioner and learned counsel appearing on behalf of the State. 2. The petitioner is apprehending his arrest in connection with Meral P.S. Case No.194 of 2025, registered under Sections 137(2), 87, 351(3), 89, 352, 126(2), 115(2), 3(5) of B.N.S., Section 3(1) (r), 3(1)(s) of SC/ST Act, and Section 4/6 of POCSO Act, pending in the court of learned Special Judge, POCSO Court, Garhwa. 3. Learned counsel appearing for the petitioner submits that the petitioner is the mother of Chotelal Yadav and the allegation is there against Chotelal Yadav of taking away the girl of the informant. He next submits that petitioner has got no criminal antecedent as disclosed in Para 14 of the petition. 4. Learned counsel appearing for the State opposed the prayer and submits that the petitioner happened to be the mother of Chotelal Yadav. 5. Looking into the contents of the FIR it transpires that the allegation of taking the girl of the informant is against Chotelal Yadav and so far as this petitioner is concerned, she happened to be 2026:JHHC:1011 2 the mother of Chotelal Yadav and the alleged occurrence is dated 20st January 2025 whereas the FIR has been lodged on 24.8.2025 and the petitioner has got no criminal antecedents as disclosed in Para 14 of the petition, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of his surrender / arrest, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) with two sureties of the like amount of each to the satisfaction of learned Special Judge, POCSO Court, Garhwa in connection with Meral P.S. Case No.194 of 2025, subject to the condition as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. 7.
