PUBLIC PROSECUTOR The Court made the following: COMMON ORDER: These four Criminal Petitions are heard together and are being disposed of by this common order, as the Petitioner is common in all four petitions, though the crimes registered against him are different. 2. The Criminal Petition No.4708 of 2026 has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.5 on bail in Crime No.157 of 2023 of RSASTF Police Station, Tirupati District, registered against the Petitioner/Accused No.5 herein for the offences punishable under Section 379 read with 34 of the Indian Penal Code, 1860 (for brevity, ‘the I.P.C.,’) and Sections 20(1)(d)(i)(a) read with 20(1)(c)(ii) read with 20(1)(c)(iii) read with 20(1)(c)(iv) read with 20(1)(c)(x),36(a) read with 32(A),29(4)(a)(i)(a) of the A.P.Forest (Amendment) Act, 2016 (for brevity, ‘the A.P Forest Act’). 3. The Criminal Petition No.4752 of 2026 has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.1 on bail in RSS 4 SC.No.208 of 2022 on the file of the learned Special Court in the cadre of Additional District & Sessions Judge for Trial of Red Sanders Smuggling Cases, Tirupati in Cr.No.24 of 2016 of RSASTF Police Station, Tirupati for the offences punishable under Sections 379 of ‘the I.P.C.,’ and Sections 20(1)(d)(i)(a) read with 20(1)(c)(ii) read with 20(1)(c)(iii) read with 20(1)(c)(iv) read with 20(1)(c)(x),36(a) read with 32(A),29(4)(a)(i)(a) of ‘the A.P Forest Act’. 4. The Criminal Petition No.4754 of 2026 has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.13 on bail in Cr.No.148 of 2023 of RSASTF Police Station, Tirupati for the offences punishable under Sections 379 read with 34 of ‘the I.P.C.,’ and Sections 20(1)(d)(i)(a) read with 20(1)(c)(ii)(iii)(iv)(x), 36(a) read with 32A of ‘the A.P Forest Act’. 5. The Criminal Petition No.4757 of 2026 has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.4 on bail in Cr.No.28 of 2019 of RSASTF Police Station, Tirupati for the offences punishable under Sections 379 read with 511 of ‘the I.P.C.,’ and Sections 20(1)(d)(i)(a) read with 20(1)(c)(ii) and 29(4)(a)(i) of ‘the A.P Forest Act’. 6. Heard the learned counsel for the Petitioner and the learned Assistant Public Prosecutor. Perused the record. 7. Sri D.Purnachandra Reddy, learned counsel for the Petitioner, submits that the Petitioner is innocent and has been falsely implicated in this case. He 5 contends that the Petitioner has not committed any offence. When the Petitioner was about to attend Court in connection with these cases, he was arrested. No fresh cases have been registered against him. The Petitioner has resolved to cooperate with the learned Trial Court for the disposal of the pending matters. Hence, it is urged to enlarge the Petitioner on bail. 8. Per contra, Mr.P.Somayaji, learned Assistant Public Prosecutor, opposed the grant of bail to the Petitioner and submits that there are similar criminal antecedents reported against the Petitioner in red sanders smuggling cases. He further submits that the investigation is not yet completed and several material witnesses remain to be examined. Hence, it is urged to dismiss the Criminal Petition. 9. On perusal of the record, the Petitioner was arraigned as Accused No.5 in Crime No.157 of 2023 of RSASTF Police Station, Tirupati District, for dealing with 10 logs of red sanders. His role came to light based on the confession of co‑accused. The Petitioner was arrested on 08.05.2026 and has been in judicial custody for the past 52 days. The investigation in Crime No.157 of 2023 is not yet completed. 10. The Petitioner is also arraigned as Accused No.1 in RSS SC No.208 of 2022 on the file of the learned Special Court in the cadre of Additional District & Sessions Judge for Trial of Red Sanders Smuggling Cases, Tirupati. Further, he is shown as Accused No.13 in Crime No.148 of 2023 of RSASTF Police Station, Tirupati, where the investigation is at a nascent stage. He is also arraigned as Accused No.4 in Crime No.28 of 2019 of RSASTF Police 6 Station, Tirupati. In all these cases, investigation is still pending. In view of the pendency of investigation, the examination of several material witnesses, and the substantial portion of investigation yet to be completed, the request of the Petitioner for enlargement on bail is not found convincing or reasonable at this stage. 11. In the result, the Criminal Petitions are dismissed. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
