Majumder …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the defendant praying for a direction upon the learned Civil Judge (Junior Division), 1st Court, Chinsurah, Hooghly to dispose of the interlocutory applications filed in Title Suit No. 107 of 2023, expeditiously. The learned advocate appearing for the petitioner submits that an application under Order 39 Rule 1 and 2 and the application under Order 39 Rule 4 of the Code of Civil Procedure are pending. He further submits that the application under Order 39 Rule 7 of the Code of Civil Procedure is also pending. He submits that the hearing of such interlocutory applications has been fixed on 5th March, 2027. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned advocate for the petitioner, this civil revision application is disposed of by requesting the learned Civil Judge (Junior Division), 1st Court, Chinsurah, Hooghly to take up the 2 hearing of the interlocutory applications on the next date fixed and make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the interlocutory applications, the learned trial judge shall make an endeavour to dispose of Title Suit No. 107 of 2023 expeditiously. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities. (Hiranmay Bhattacharyya, J.)
