Learned advocate appearing for the petitioner submits that there was alleged recovery of 286 grams of brown sugar/heroin from the present petitioner and petitioner is in custody for more than eight and half months. Charge-sheet has already been submitted before the jurisdictional Court. Learned advocate appearing for the State has produced the Case Diary as well as rebutted the contention relating to the chemical examiner’s report as has been contended by the petitioner. Having considered the materials appearing in the Case Diary, I am of the opinion that this is not a fit case for releasing the petitioner on bail at this stage. Accordingly, CRM (NDPS) 2006 of 2026 is dismissed. Memo of evidence submitted by the State be kept with the record.
2 All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
