Vakalath is filed on behalf of second respondent No.2. Same is taken on record.
2. The petition is filed to quash the proceedings in C.C. No.30723/2025 pending before the XXXVII Additional Chief Judicial Magistrate-Bangaluru arising from Crime No.48/2025.
3. The charge sheet is filed for the offence under Section 85 of Bharatiya Nyaya Sanhita, 2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961.
4. The application is filed by the petitioner and the second respondent to quash the proceedings on the ground that the dispute between the petitioner/husband and the second respondent/wife is amicably settled and it is submitted Digitally Signed by ANANT RAMNATH HEGDE

that the divorce petition is filed under Section 13B of Hindu Marriage Act, 1955 seeking dissolution of marriage through mutual consent in M.C. No.4826/2026 and the same is pending
consideration.
5. The second respondent who is present before the court submits that she has voluntarily agreed to seek divorce and she has agreed to receive Rs.10,00,000/- as alimony. The complainant present before the court would submit that she does not wish to prosecute the matter.
6. Since the matrimonial dispute is settled and the petitioner and the second respondent are seeking mutual divorce, the court is of the view that there is no justification in directing prosecution and trial.
7. Hence, the following:
ORDER
