This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Div.) at Ranaghat to dispose of the Title Suit No.35 of 2001 expeditiously. Mr. Chattrjee, learned advocate appearing for the petitioners submits that the preliminary decree was passed on June 28, 2010 and, thereafter, a Commissioner was appointed in connection with the final decree proceedings. He further submits that the commission work has already been concluded but the Commissioner’s report is yet to be filed by the partition Commissioner before the learned trial judge. He submits that September 3, 2026 was the date fixed for filing of the Commissioner’s report, but no report was filed on that date and the next date is fixed sometime in the month of November, 2026. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party

or the learned advocate representing the opposite party before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioner, CO 3214 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Div.) at Ranaghat to take necessary steps and ensure that the Commissioner’s report reaches the Court on or before the next date of hearing. The learned trial judge is requested to dispose of the Title Suit No.35 of 2001 as expeditiously as possible but preferably within a period of four months from the next date fixed without granting any unnecessary adjournments to either of the parties. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
