This petition is filed to quash the proceedings in Crime No.568/2026 registered by Madanayakanahalli Police Station for the alleged offences punishable under Sections 126(2), 115(2), 118(1), 352, 351(2), 324(4) read with Section 190 of the Bharatiya Nyaya Sanhita, 2023. 4. Learned counsel for the petitioners submits that, the alleged incident has not taken place. The complainant is in the habit of filing such complaints. 5. Learned High Court Government Pleader would submit that the investigation is going on and wound certificate would reveal that there are injuries to the complainant/victim. 7. Since the investigation is not yet complete, the Court is of the view that, the investigation has to be completed as the ingredients of the offence is forthcoming. Whether the incident has really taken place or not has to be ascertained by the police and appropriate report has to be filed. 8. Petition is dismissed. 9. Merely because the petition is dismissed, it should not be construed as having expressed anything against the petitioner. 10. All contentions kept open.
