The revisional application has been preferred against an order dated 25.11.2025 passed by the learned Judicial Magistrate, 1st Court at Barasat, North 24 Parganas, in M. Ex. Case No. 267 of 2025. 2. It appears that a Coordinate Bench of this Court in CRR 2932 of 2025 had directed expeditious disposal of the proceedings pending before the learned Magistrate taking into consideration that the petitioner herein is a patient with advance stage of cancer and has prayed for maintenance from her son. The trial Court did proceed as per direction of the High Court. 3. It is submitted by the learned counsel for the petitioner that he has filed summons in the execution case. The Court has issued summons but has fixed the date in the month of March, 2026, which again is a long date for a person with an ailment like that of the petitioner. 4. Considering the said facts, materials on record and the nature of relief prayed for, service is dispensed with. 5. The criminal revision is disposed of with the direction that the Executing Court shall take up the matter for hearing on 27th January, 2026 with due notice to the other side and on being 2 satisfied about the service of summons in the execution proceedings. 6. The trial Court is directed to be diligent in this case, considering the facts and circumstances as observed in the order herein. 7. CRR 5469 of 2025 stands disposed of. 8. Connection application, if any, stands disposed of. 9. Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
