JUSTICE D K SINGH) The present contempt petition has been filed alleging willful disobedience and non-compliance of the order dated 31.03.2023 passed by the Writ Court in Writ Petition No.2564/2023 (GM-RES). 2. The said order reads thus: “The petitioner is before this Court calling in question an order dated 10.03.2022, passed by the Chief Judicial Magistrate, Bengaluru Rural District, Bengaluru, under Section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 in Crl.Misc.No.52/2021. 2. Heard Sri Vikram A. Huilgol, learned senior counsel for the petitioner and Sri K.V.Lokesh, learned counsel for respondent No.1. 3. It transpires that the issue between the parties have been settled and the petitioner has filed a memo depicting the terms of settlement in the form of an affidavit of undertaking. The affidavit runs into several pages. Therefore, all the observations in the affidavit of undertaking would be treated as a part and parcel of the present order. 4. The learned senior counsel for the petitioner would submit that Rs.25/- lakhs in terms of the affidavit of undertaking is made by handing over a demand draft to the learned counsel - 4 - HC-KAR CNR: KAHC010463202023 NC: 2026:KHC:51174-DB CCC No. 871 of 2023 representing the first respondent – Finance Company and he would acknowledge the same. 4 (a). The co-ordinate Bench in the order dated 08.10.2021, in W.P.No.18422/2021, has held as follows: “In the above circumstances, this writ petition is disposed off granting reprieve to the petitioner as mentioned above and in terms of memo; the memo shall be treated as the undertaking given to the Court and not only as a bargain between the parties; thus, violation of thereof per se amounts to contempt of this Court." 5. With the aforesaid observations and in terms of the affidavit of undertaking, the writ petition stands disposed. I.A.No.2/2023 is disposed, as a consequence.” 3. As per the memorandum of the contempt petition, in particular paragraph-6, it is noticed that the contemnor has paid Rs.25 lakhs. The allegation in the contempt petition is that the W.P.No.2564 of 2023 was disposed of, following the order passed by Co-ordinate Bench of this Court in W.P.No.18422 of 2021. We do not find that such a submission can be taken into account as the impugned order dated 31.03.2023 is in respect of the - 5 - HC-KAR CNR: KAHC010463202023 NC: 2026:KHC:51174-DB CCC No. 871 of 2023 memo of undertaking in the form of the affidavit filed by the respondent/contemnor. 4. Since Rs.25,00,000/- has already been paid by the respondent/contemnor, no contempt is made out by the complainant. Accordingly, the contempt petition is dismissed.
