JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. Accused no.1 in S.C.No.156/2025 pending before the Court of VI Addl. District & Sessions Judge, Tumakuru, arising out of Crime No.87/2025 was registered by Hebburu Police Station, Tumakuru District, for the offences punishable under Sections 310(4) & 310(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.87/2025 was registered by Hebburu Police Station, Tumakuru District, for the aforesaid offences against four to five unknown persons based on the first information dated 20.05.2025 received from Byregowda.G.S., Police Officer attached to Hebburu Police Station. In the said case, petitioner was arrested on 20.05.2025 and remanded to judicial custody. After completing investigation, charge sheet is filed against five persons and petitioner is arrayed as accused no.1 in the charge sheet. His bail application filed before the - 3 - HC-KAR CNR: KAHC010622352026 NC: 2026:KHC:52302 CRL.P No. 13947 of 2026 Trial Court in Crl. Misc. No.630/2026 was rejected on 20.05.2026. Therefore, petitioner is before this Court. 4. The allegation against the accused persons in the present case is that on the alleged date of incident, they had prepared themselves to commit dacoity and were armed with weapons. The first informant based on the credible information received by him, had registered the FIR for the aforesaid offences against unknown persons and in the raid that was conducted to the alleged spot where the accused persons were preparing to commit dacoity, he had apprehended five persons and petitioner is one amongst the said five persons. 5. Investigation of the case is completed and charge sheet has been filed. In the earlier criminal cases registered against the petitioner, he is said to have been enlarged on bail. The Hon'ble Supreme Court in the case of PRABHAKAR TEWARI VS. STATE OF UTTAR PRADESH AND ANOTHER - (2020) 11 SCC 648, has observed that a person's criminal antecedents cannot be the sole ground to reject his prayer for grant of bail, if he is otherwise found entitled for the same. - 4 - HC-KAR CNR: KAHC010622352026 NC: 2026:KHC:52302 CRL.P No. 13947 of 2026 6. In the present case, petitioner has undertaken to cooperate before the Trial Court for speedy disposal of the case. Considering the aforesaid aspects, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively, subject to appropriate conditions. Accordingly, the following order: 7. The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.156/2025 pending before the Court of VI Addl. District & Sessions Judge, Tumakuru, arising out of Crime No.87/2025 was registered by Hebburu Police Station, Tumakuru District, for the offences punishable under Sections 310(4) & 310(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 5 - HC-KAR CNR: KAHC010622352026 NC: 2026:KHC:52302 CRL.P No. 13947 of 2026 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off; f) The petitioner is directed to appear before the Station House Officer, Hebburu Police Station, on third Sunday of every month between 10.00 a.m. and 01.00 p.m. and mark his attendance, for a period of one year from the date of his release.
