JUSTICE ANANT RAMANATH HEGDE ORAL ORDER Heard the learned counsel appearing for the petitioner and the learned counsel Additional State Public Prosecutor appearing for respondent No.1 - State 2. This petition is filed to quash the proceedings in Crime No.401/2026 registered by Tunga Nagar Police, Shivamogga for the offences alleged under Sections 352, 115(2), 118(1), 109 and 190 of Bharatiya Nyaya Sanhita, 2023 ('BNS') pending on the file of JMFC, Shivamogga. 3. Learned counsel for the petitioner would submit that at the time of alleged incident, petitioner was riding a bike which was at a distance of 4 kilometres away from the scene of offence. To substantiate his contention, petitioner has already furnished the CCTV footage to the jurisdictional Police. It is his apprehension that the CCTV footage may not be considered by the Police. 5. Learned Additional State Public Prosecutor would submit that all relevant materials will be looked into at the time of investigation. 6. Under these circumstances, there is no need to quash the proceedings. 7. However, the Police shall consider all the relevant materials to be submitted by the petitioner in support of his contention. After considering the same, appropriate report shall be filed. 8. Accordingly, the Criminal Petition is dismissed.
