Ahmad is praying for quashing of the FIR dated 25.02.2026, bearing Case Crime No. 0030 of 2026 lodged for the offence punishable under Section 22/8 of the NDPS Act, at P.S. Pulbhatta District U.S. Nagar. 4. It is argued by the learned counsel for the petitioner that in the aforesaid FIR the present petitioner is made an accused for the offence punishable under Section 29 of the NDPS Act and now proceeding under Section 84 of BNSS 2023 has been initiated. 5. Mr. Saurabh Kumar Pandey, learned counsel for the petitioner on instruction submits that the petitioner’s wife is pregnant and is at an advance stage, therefore, the petitioner may be given two weeks’ time to surrender before the court concerned. 6. Prayer, as made, appears to be innocuous. 7. Learned counsel for the State has no objection. 8. In such view of the matter, the instant writ petition is dismissed as withdrawn with the direction to the petitioner to surrender before the court concerned on or before 23.04.2026. Till then the respondents are restrained from taking further steps pursuant to the proceeding initiated under Section 84 of BNSS 2023. 9.
