1. Ms. Aishwarya Thapliyal, learned counsel holding brief of Mr. Abhishek Verma,
learned counsel for the applicant.

3. Present applicant Aaris, S/ o Ayyub is praying for bail in relation to FIR dated 22.09.2025, bearing FIR/ Case Crime No. 0417 of 2025 at P.S. Kashipur, District Udham Singh Nagar, wherein the applicant has been implicated for the offence punishable under Section 191(2), 191(3), 121(1), 132, 221, 352, 351(2), 324(3), 190, 196(C) , 109 of BNS 2023 and Section 7 of Criminal Law Amendment Act.

Learned counsel for the applicant argued that the applicant is not named in the FIR and the applicant has no criminal history and he is working in a furniture shop and the only role which has been assigned to the present applicant that he was present at the time of incident, but there is no any evidence that he was actively participated in the procession. She also submits that the charge sheet has also been filed.
5. On the other side, Mr. Himanshu Sain, learned Brief Holder for the State have not disputed this fact that the charge sheet has already been filed and the applicant has no previous criminal history.
6. After hearing the arguments of the

consideration that the charge sheet has already been filed and the applicant has no previous criminal history, this Court is of the view that the present applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed.
8. Let the applicant
“Aaris” be released on bail on her executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
