1. By way of filing the instant criminal misc. petition, a limited prayer has been made for issuing directions to the Metropolitan Magistrate No.13, Jaipur Metropolitan, Jaipur to expedite the proceedings of Criminal Case No.874/2018.

Learned counsel for the petitioner pleads no instructions and submits that he is not in contact with the petitioners.
3. Looking to the limited aforesaid prayer made in the instant petition, this Court deems it just and proper to decide the instant petition.

The contents of the petition indicates that an FIR No.869/2013 was registered against the petitioners with Police Station Vaishali Nagar, Jaipur City (South) for the offences punishable under Sections 406, 420, 467, 468, 471, 504 and 120B IPC, wherein charge-sheet was submitted against them and cognizance was taken for the above stated offences and under Sections 4, 5 and 6 of the Chit Fund Act by the Court of Metropolitan Magistrate No.14, Jaipur Metropolitan, Jaipur vide
order dated 22.08.2015 and thereafter, charges were framed and the trial has commenced. Perusal of the petition further indicates that statements of one witness PW-1 Govind Ram Swami were recorded way back in the year 2014. It appears that the petitioner is facing trial since 2015 and more than 11 years have passed thereafter.
5. As per the judgment passed by the Hon’ble Apex Court in the case of High Court Bar Association Allahabad Vs. State of Uttar Pradesh & Ors. reported in 2024 (6) SCC 267, the relief sought for cannot be granted, as the Constitutional Courts cannot issue such direction to the Trial Courts to conclude the trials in a fixed time bound schedule. But looking to the fact that the case is lying pending since last more than a decade, it is expected from the learned Magistrate to make all possible endeavours to expedite the proceedings of the pending case.
6. With the aforesaid observations, the instant criminal misc. petition stands disposed of. The stay application and all pending applications, if any, also stand disposed of.
