Civil Judge, JMFC Hiriyuru (charge sheeted for the offences punishable under Sections 420, 465, 468, 471, 474 read with Section 34 of IPC in Crime No.35/2020 of Hiriyuru Town Police Station) against the petitioner/ accused No.13 in the interest of justice." 2. FIR in Crime No.35/2020 had been registered by the Hiriyuru Police Station. This Court, vide order dated 21.10.2020, in Criminal Petition No.3027/2020, taking into consideration that there is one other similar identical matter which has been investigated by the CID in Crime No.65/2019, had transferred Crime No.35/2020 to be investigated by the CID. The grievance of the petitioner is that even though the petitioner has been dropped from the charge sheet, summons have been issued in Crime No.35/2020 and the matter is now pending in CC No.1691/2024. 3. The submission of learned counsel for the petitioner is that there being no charge sheet which has been laid insofar as petitioner/ accused No.13 is concerned, no summons could have been issued. Learned HCGP and learned counsel for respondent No.2 also concurred with the said submission. They also state that no charge sheet has been laid insofar as the petitioner/ accused No.13 is concerned in Crime No.35/2020. However, charge sheet has been laid against accused No.13 in Crime No.65/2019. The respondents will proceed against the petitioner in those proceedings. In that view of the matter, this Court passes the following: ORDER i. This Criminal Petition is allowed. The order dated 17.12.2024 passed in Crime No.35/2020 by the Principal Civil Judge, JMFC Hiriyuru insofar as issuing summons to the petitioner who is arrayed as accused No.13 therein, is hereby quashed. ii. Consequently any other order passed thereafter directing re-issuance of summons or the like are also quashed.
