Learned advocate for the petitioner submits that the petitioner is in custody since 31.12.2024 and the subject- matter of the case relates to alleged recovery of 100 bottles of Fairdyl cough syrup. State opposes the prayer for bail and submits that the petitioner happens to be a foreigner and not an Indian national who was involved in such clandestine dealing of cough syrup. Having regard to the fact that the rigors of section 37 of the NDPS Act are attracted, I am not inclined to grant bail to the petitioner at this stage.
2 Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM (NDPS) 2011 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
