JUSTICE LALITHA KANNEGANTI ORAL ORDER The present writ petition is filed seeking the following prayer: “PRAYER Wherefore, the Petitioner most humbly prays that this Hon'ble Court may be pleased to: A) Issue a Writ of Mandamus or any other appropriate Writ, order, or direction, directing the III Addl. Family Judge, Family Court at Bengaluru, to fast-track and expeditiously dispose of M.C.No.3234/2020 within a strict, time-bound period of 6 (Six) months (or as this Hon'ble Court deems fit), without allowing any further unnecessary adjournments to either side. B) Pass any such other orders or reliefs as this Hon'ble Court may deem fit in the facts and circumstances of the case, including the costs of the proceedings, in the interest of justice.” - 3 - HC-KAR CNR: KAHC010503642026 NC: 2026:KHC:51410 WP No.22863 of 2026 2. In the light of the judgment of the Hon'ble Apex Court in the case of High Court Bar Association Allahabad Vs. The State Of Uttar Pradesh in Crl.A.No.3589/2023 dated 29.02.2024, wherever a mandamus is sought, just like that, this Court cannot pass an order for the sake of asking. 3. Learned counsel for the petitioner has drawn the attention of this Court to the order sheet and submits that the respondent is repeatedly seeking time and is dragging out the proceedings. 4. The Family Court has to proceed with the matter in accordance with law and unnecessary adjournments shall not be granted. In a matter of 2020, even as of 2026, the evidence has not yet started. Hence, this Court is passing the following order: ORDER i. Accordingly, the writ petition is disposed of, directing the Family Court to go ahead with the matter in accordance with law and not to grant unnecessary adjournments. - 4 - HC-KAR CNR: KAHC010503642026 NC: 2026:KHC:51410 WP No.22863 of 2026 ii.
