Learned advocate appearing for the petitioner submits that petitioner is in custody for about six months, there has been no recovery from the present petitioner and even the charge-sheet which has been filed would point to another accused being involved in the alleged offence. Learned advocate appearing for the State has produced the Case Diary, drawn the attention of the Court to the statement of the witnesses as also the post-mortem report. I have taken into account the statements of the relations of the deceased which reflects that the wife of the deceased having illicit relationship with the present petitioner and consequential acts flowing after the same. Having regard to the complicity of the petitioner and the heinousness of the crime, I am not inclined to release the petitioner on bail at this stage.
2 Accordingly, prayer for bail of the petitioner in CRM (M) 2051 of 2026 is dismissed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
