Rakib (Rejected) CRM (NDPS) 1890 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Gaighata Police Station Case no. 1029 of 2023 dated 19.10.2023 under Sections 21(c)/25/25A/27A/29 of the NDPS Act. And In the matter of : Kakoli Roy ……Petitioner. Mr. Soumik Ganguli Ms. Priti Barman ......for the Petitioner. Mr. Kallol Mondal, Ld. PP Mr. Anamitra Banerjee Mr. Sreyash Kr. Singh ……for the State. Learned advocate appearing for the petitioner submits that unnecessarily petitioner is languishing in jail for two years ten months and only 14 witnesses out of 29 witnesses cited in the charge-sheet have been examined till date. Earlier there was a direction by this Court in respect of another accused. There was a specific plea taken up by the State that in respect of other accused where cross-examination was deferred for a period of seven months. Be that as it may, prosecution is directed to complete rest of the witnesses within a period of six months from the next date fixed. Petitioner would renew his prayer for bail, in case, the prosecution witnesses are not completed within the aforesaid scheduled and there are circumstances to show that in spite of 2 cooperation rendered by the accused persons the evidence of all the witnesses could not be completed for other reasons. Learned trial Court is directed to continue with the trial in spite of any resolution of the local bar and without granting any unnecessary adjournment to either of the parties. With the aforesaid directions, at this stage CRM (NDPS) 1890 of 2026 is dismissed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
