This application under Article 227 of the Constitution of India is at the instance of the defendant praying for a direction upon the learned Civil Judge (Sr. Div.), 2nd Court at Barasat to dispose of application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure filed in Title Suit No.13787 of 2014 expeditiously. The learned advocate appearing for the petitioner submits that the injunction application is otherwise ready for hearing and March 12, 2027 has been fixed for hearing of such application. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioner, CO 3229 of 2026 stands disposed of by requesting the learned Civil Judge (Sr. Div.), 2nd Court at Barasat to take up hearing of the application under Order XXXIX Rules 1 and 2 of the Code of Civil

Procedure on the next date fixed, if the same is otherwise ready for hearing and to make an endeavour to dispose of the said application as expeditiously as possible without granting any unnecessary adjournments to either of the parties. After disposal of the said application and any other interlocutory applications, that may be pending, the learned trial judge shall make an endeavour to dispose of the Title Suit No.13787 of 2014 as expeditiously as possible keeping in mind that the said suit is pending from the year 2014. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
