Accused no.6 in Crime No.254/2026 registered by Bidadi Police Station, Bengaluru South District, for the offences punishable under Sections 351(2), 336(3), 336(2), 340(1), 352, 316(2), 318(4) read with 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.254/2026 was registered by Bidadi Police Station, Bengaluru South District, for the aforesaid offences against Yallamma and others based on the first information dated 24.07.2026 received from Shankar S/o late Chinnappa. In the said case, petitioner was arrested on 02.08.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.605/2026 was rejected on 31.08.2026. Therefore, petitioner is before this Court. - 3 - HC-KAR CNR: KAHC010638132026 NC: 2026:KHC:52706 CRL.P No. 14249 of 2026 4. A reading of the first information would reveal that one Ramegowda has filed a civil suit before the jurisdictional Civil Court in O.S.No.159/2025 against the first informant - Shankar. It appears that the advocate appearing on behalf of Shankar in the aforesaid suit had advised him to procure certain documents and he allegedly had asked Shankar to approach the petitioner for the purpose of getting the said documents. Shankar, allegedly, therefore had paid Rs.13 lakhs to the petitioner for the purpose of furnishing him the documents relating to the property which is the subject matter of the aforesaid suit. The allegation now made in the first information is that though petitioner had received the aforesaid amount of Rs.13 lakhs with an assurance to provide the documents, subsequently the petitioner had made an attempt to furnish fraudulent documents and on request to repay the amount, petitioner allegedly had threatened the first informant of dire consequences. It is further alleged that some of the accused persons named in the FIR also had assaulted the first informant. It is under these circumstances, FIR was registered against Yallamma and others for the aforesaid offences. - 4 - HC-KAR CNR: KAHC010638132026 NC: 2026:KHC:52706 CRL.P No. 14249 of 2026 5. Petitioner who has no criminal antecedents is in custody in the present case for the last more than one month. Considering the nature of allegations found against the petitioner and the maximum punishment provided for the alleged offences, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.254/2026 registered by Bidadi Police Station, Bengaluru South District, for the offences punishable under Sections 351(2), 336(3), 336(2), 340(1), 352, 316(2), 318(4) read with 3(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless - 5 - HC-KAR CNR: KAHC010638132026 NC: 2026:KHC:52706 CRL.P No. 14249 of 2026 the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future.
