ORAL ORDER
1. Accused nos.1, 4, 5 and 6 are before this Court in these two petitions filed under Section 483 of BNSS, 2023 seeking regular bail in Crime No.133 of 2026 registered by Kempapura Agrahara, Bengaluru City for offences punishable under Sections 140(1), 109, 127(2), 351(3), 319(2), 329(3),

61(2), 3(6) of BNS, 2023 and Section 25(1)(B)(b) of Indian Arms Act, 1959. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.133 of 2026 was registered by Kempapura Agrahara, Bengaluru City for offences punishable under Sections 140(1), 109, 127(2), 351(3), 319(2), 329(3) & 3(6) of BNS, 2023 against the petitioners herein and another, based on first information dated 16.06.2026, received from Sri Mohammed Imaran, son of Mohammed Akrma. In the said case, accused nos.1, 4, 5 and 6 were arrested on 16.06.2026 and accused no.2 was arrested on 30.06.2026. Subsequently, they were remanded to judicial custody and their bail application filed before the jurisdictional Sessions Court was rejected. Therefore they are before this Court. 4. A reading of the first information dated 16.06.2026 would reveal that, the first informant had received money from the accused persons for supply of drugs and since, he had failed to supply drugs to them, they allegedly had demanded

repayment of the said money. Since, the first informant had failed to repay the money received by him from the accused persons for supply of drugs, they allegedly kidnapped him in a car and assaulted him. Thereafter, they had gone to his house and collected a sum of Rs.50,000/- from his wife and subsequently released him. Investigation of the case is now completed and charge sheet is filed. 5. Learned HCGP has submitted that the injured victim has suffered only simple injuries in the incident in question. He has brought to the notice of this Court that accused no.1 and 4 are persons with criminal antecedents. 6.
Considering the nature of allegations found against the petitioners in the present case and the injuries sustained by the first informant, I am of the opinion that their prayer for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. Accordingly, the following:-
ORDER (i) Criminal petitions are allowed.

(ii) The petitioners are directed to be enlarged on bail in Crime No.133 of 2026 registered by Kempapura Agrahara, Bengaluru City for offences punishable under Sections 140(1), 109, 127(2), 351(3), 319(2), 329(3), 61(2), 3(6) of BNS, 2023 and Section 25(1)(B)(b) of Indian Arms Act, 1959, subject to the following conditions:- a) Accused nos.1, 4, 5 & 6 shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) Accused nos.1, 4, 5 & 6 shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) Accused nos.1, 4, 5 & 6 shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) Accused nos.1, 4, 5 & 6 shall not involve in similar offences in future. e) Accused nos.1, 4, 5 & 6 shall not leave the jurisdiction of the Trial Court without permission

of the said Court until the case registered against him is disposed off. f) Accused nos.1 and 4 shall appear before the Station House Officer, Kempapura Agrahara Police Station, Bengaluru City on every fourth Sunday of the month between 10.00 a.m. and 1.00 p.m., and mark their attendance regularly for a period of one year from the date of their release from custody.
