This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No.627/2025 registered at Police Station Kota, Bilaspur (CG) for the offences under Sections 137(2), 87, 64(2) (M) of BNS and Section of BNS 2023, section 5(L) & 6 of the POCSO Act.
2. As per the prosecution case, on 22.06.2025 the complainant lodged a report that on 15.06.2025 an unknown person had allured ALLENA ANNAJEE RAO Digitally signed by ALLENA ANNAJEE RAO Date: 2026.04.06 15:45:24 +0530
2 and enticed away his younger minor daughter from their lawful guardianship. During investigation, it was found that the present applicant abducted the minor victim and repeatedly committed sexual intercourse with her from 15.06.2025 to 19.01.2026.

Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and the victim was not recovered from the possession of the applicant. He has not committed any offence with the victim. He submits that the applicant is in jail since 20.01.2026; the trial has not yet commenced and there is no immediate possibility of disposal of case, therefore, he may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail application and submits that at the time of incident, the victim was minor and the applicant had taken her away from the lawful custody of her parents for committing sexual intercourse.
5. The victim along with her father has appeared in person before this Court and expressed no-objection to granting bail.

Having considered the submissions made by learned counsel for the parties and the over all facts situation of the case especially the fact that the trial has not yet commenced, I am not inclined to release the applicant on regular bail.
