Accused Nos.1, 4 and 5 in Crime No.183/2026 registered by Koratagere Police Station, Tumakuru, for the offences punishable under Sections 3 and 4 of the Explosive Substances Act, 1908 and Sections 288 and 325 of BNS, 2023, are before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.183/2026 was registered by Koratagere Police Station, Tumakuru, for the aforesaid offences against unknown persons based on the first information dated 18.08.2026 received from Smt. Nagarathnamma, W/o Muddappa. In the said case, petitioners were arrested on 22.08.2026 and remanded to judicial custody. Their bail application filed before the jurisdictional Sessions Court in - 3 - HC-KAR CNR: KAHC010653742026 NC: 2026:KHC:53266 CRL.P No. 14439 of 2026 Crl.Misc.No.5336/2026 was rejected on 08.09.2026. Therefore, they are before this Court. 4. A reading of the first information would reveal that on 17.08.2026, at about 05.45 p.m., pet dog of the first informant found a ball covered with white thread near their house and when the said dog picked up the said ball in its mouth and attempted to bite the same, the said ball suddenly exploded and as a result, the dog died at the spot. It is under these circumstances, FIR was registered against unknown persons on 18.08.2026 at about 16.30 hours. During the course of investigation, petitioners herein were arrested and remanded to judicial custody. According to the prosecution, petitioners, who had purchased sulphur and potassium from the shop of accused No.6 had thereafter tied the same in a cover using thread and had prepared a ball which was being used by them for the purpose of hunting wild animals. It appears that the explosive ball prepared by the accused persons was accidentally bit by the dog and as a result, the ball had exploded and the dog had died. Accused No.6, who had supplied the explosive material to petitioners has been granted regular bail in the present case by - 4 - HC-KAR CNR: KAHC010653742026 NC: 2026:KHC:53266 CRL.P No. 14439 of 2026 the jurisdictional Session Court in Crl.Misc.No.5333/2026 vide order dated 10.09.2026. 5. It appears that as against the petitioners, a similar case is registered by Kodigehalli Police Station, Tumakuru. After the present FIR was registered, petitioners were arrested and during the course of interrogation, they allegedly had confessed to the present crime and it is under these circumstances, they are arraigned as accused in the present case. Major portion of the investigation is already completed. The alleged offences are not punishable with death or life imprisonment. Petitioners have undertaken to abide by the conditions that may be imposed on them by this Court. Accordingly, the following order:- 6. The petition is allowed. The petitioners are directed to be enlarged on bail in Crime No.183/2026 registered by Koratagere Police Station, Tumakuru, for the offences punishable under Sections 3 and 4 of the Explosive Substances Act, 1908 and Sections 288 and 325 of BNS, 2023, subject to the following conditions: - 5 - HC-KAR CNR: KAHC010653742026 NC: 2026:KHC:53266 CRL.P No. 14439 of 2026 a) Petitioners shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against them is disposed off.
