And In the matter of : Najmul Sekh ……Petitioner. Mr. Navanil De Mr. Srinjan Ghosh Ms. Rishita Chakraborty ......for the Petitioner. Mr. Avrojyoti Das, Ld. APP Mr. Reshab Kumar Mr. Sanjay Mazumdar ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody for about 14 months, charge-sheet refers to 11 witnesses and there is no possibility of the trial being taken to its logical conclusion. As such, petitioner be released on bail on any stringent condition. Learned advocate appearing for the State opposes the prayer for bail as commercial quantity of contraband has been seized which is 25.405 kgs of ganja. I have taken into account the quantum of seizure wherein rigors of Section 37 of the NDPS Act is attracted. As such, I am not inclined to release the petitioner on bail at this stage. 2 Learned trial Court is directed to prepone the evidence of the seizure list witnesses and complete the same within a period of three months from date. Petitioner will communicate this order to the learned trial Court at the earliest. Petitioner would renew his prayer for bail after the time period is over. With the aforesaid observations, CRM (NDPS) 568 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
