Mr. Tewary, learned counsel appearing for the RPFO submits that the attachment order has been revoked in view of this Court’s order dated 31.08.2026. The only submission, Mr. Tewary makes on instruction, is that certain deposit may be directed to be made by the petitioner herein before the Tribunal. 3. Mr. Majumder, learned senior counsel appearing for the petitioner submits that the appeal preferred by him is accompanied by an application under Section 5 of the Limitation Act along with an application for waiver of the said pre-deposit. It is thus submitted that unless the waiver application is considered by the tribunal, the petitioner is not in a position to deposit any amount. 4. Accordingly, the writ application is disposed of with liberty granted to the respondent/EPFO to make 2 the said prayer before the tribunal at the time of hearing of the waiver application, which the learned CGIT, Kolkata shall consider in accordance with law. 5. It is further directed that the order of stay as granted by this Court vide order dated 31.08.2026 shall remain in force till the matter is taken up for consideration by the learned CGIT, Kolkata. 6. Writ application stands disposed of. 7. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
