Pooja Sharma Mr. Samrat Choudhury Mr. Sayan Roy Mr. Archan Dutta …for the Petitioner Being aggrieved by and dissatisfied with the delay in hearing of the proceeding being Misc. case no. 252 of 2025 arising out of ACM Case no. 284 of 2012 under Section 127 of the Code of Criminal Procedure, presently pending before learned Judicial Magistrate, 5th Court, Alipore, the petitioner has preferred the instant application and prayed for appropriate direction upon the court below for expeditious disposal of the said Misc. case. Having heard learned counsel for the petitioner, I find that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice and as such, the service of copy of application upon the opposite party is hereby dispensed with. Having considered the prayer made on behalf of the petitioner and that the proceeding is pending for disposal since 1st June, 2025, I find that prayer made by the petitioner is justified and is required to be allowed to secure the ends of justice. 2 In view of the above, the instant application being CRR 1532 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the Misc. case no. 252 of 2025 and to make his best effort to conclude the hearing of the said Misc. case preferably within a period of three months from the next date of hearing. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities. (Dr. Ajoy Kumar Mukherjee, J.)
