21.09.2026 05 Court No. 05 (DL) (Suvendu Mukherjee) IN THE HIGH COURT AT CALCUTTA Constitutional Writ Jurisdiction (APPELLATE SIDE) WPA 21327 of 2026 Kalyan Ranjan Coomer & Ors. –Versus – The State of West Bengal & Ors. Mr. Sujit Kumar Rath Mr. Sukumar Sarkar ….for the petitioners Ms. Indrani Chakraborty Mr. Deb Kumar Chandra …for the State respondents Mr. Sandip Ghosh Mr. Partha Sarkar Ms. Mousumi Chatterjee Ms. Jayashree Dari …for the respondent nos. 5-14 1) Affidavit of service filed on behalf of petitioners is taken on record. 2) By presenting this writ petition, prayer is made for directing concerned police authorities to take steps which will permit petitioners to cultivate land in question. 3) State respondents and respondent nos. 5 to 14 are represented by learned advocates who have jointly submitted that issue is pending before the civil court in view of instituting suit by petitioners being Title Suit No. 525 of 2023. 2 4) Learned advocate representing State respondents has filed a communication dated 28th August, 2026 of Officer-in-Charge, Pandua Police Station and same is taken on record. Copies of said communication are made over to learned advocates representing petitioners and respondent nos. 5 to 14. 5) On hearing learned advocates representing parties and taking note of contents of communication dated 28th August, 2026, it appears that civil court passed an order on 28th November, 2024 in connection with aforesaid suit thereby directing parties to maintain status quo in respect of nature, character and possession of suit property till disposal of said suit. Subsequently plaintiffs filed an application under Section 151 of the Code of Civil Procedure on which civil court passed an order dated 17th March, 2025 thereby directing concerned police authority to take steps to maintain status quo in respect of cultivation by maintaining peace and tranquility. 6) Since civil court passed an order to maintain status quo in respect of nature, character and possession of the suit property without deciding right of parties over agricultural land in question, at this stage court is not inclined to give direction upon concerned police authorities to take steps for preserving right of petitioners over agricultural land in question. 7) Writ petition stands disposed of. 8) However, this order shall not preclude learned Civil Judge (Junior Division), 2nd Court, Hooghly to decide 3 the issue without being influenced by observations made on this writ petition. 9) Parties to act on server copy of this order duly downloaded from official website of this Court.
