JUSTICE RAJESH RAI K ORAL ORDER During the course of arguments, it is submitted by learned HCGP that a discharge application has been filed by the petitioner before IV Addl. Chief Metropolitan Magistrate, Bengaluru in C.C.No.5706/2020 and as such, the petitioner cannot avail the remedy before the Trial Court by filing discharge application as well as in this petition simultaneously. 2. The assertion of the learned HCGP that a discharge application is filed by the petitioner before the Trial Court is not disputed by the learned counsel for the petitioner. However, he submits that the discharge application filed by the petitioner is pending for consideration from long time and the learned Magistrate has not considered the same due to various reasons. 3. Having considered the submissions advanced, with a direction to the learned Magistrate to consider the discharge - 3 - HC-KAR CNR: KAHC010001492024 NC: 2026:KHC:52371 CRL.P No. 186 of 2024 application filed by the petitioner in accordance with law within an outer limit of three months from the date of receipt of certified copy of this order, the petition is disposed of.
