Counter affidavit filed on behalf of informant in the Court today is taken on record. 2. Heard learned counsel for the applicant, learned counsel for the informant, learned A.G.A. for the State and perused the material on record. 3. By means of this application, the applicant who is involved in Case Crime No. 470 of 2025, under Sections 118(1), 352, 351(2) and 109(1) of B.N.S., P.S. Sarsawa, District-Saharanpur, is seeking enlargement on bail during the trial. 4. Learned counsel for the applicant has submitted that the applicant is absolutely innocent and has been falsely implicated in the present case due to some ulterior motive. He next submitted that the allegation as alleged in the first informant report is totally false and baseless. This incident was only witnessed by the brother of the alleged victim and his testimony cannot be considered credible, as he was an 'interested witness.' There was no independent witness of the alleged incident. No statement of the alleged victim was recorded under Section 183 of B.N.S.S. He lastly submitted that the applicant, who has no criminal antecedents to his discredit and he is in jail since 26.11.2025, is entitled to be enlarged on bail during pendency of the trial. 5. The prayer for bail has been vehemently opposed by leaned counsel appearing on behalf of informant, as well as learned A.G.A. for the State. After having considered the submissions made by learned counsel for the applicant, learned counsel for the informant as well as learned A.G.A. and perused the material brought on record including the statement of doctor, in which he has specifically stated that the injury sustained by the injured could be dangerous to life as the body, i.e neck, head and left hand have sustained burn injuries, hence this Court is not inclined to enlarged the accused-applicant on bail. 7.
