Mr. Debapriya Samanta …for the Union of India. 1. The petitioner and the respondent nos.1, 2 and 3 are represented. 2. Affidavit of service, filed on behalf of the petitioner in Court today, is taken on record. 3. It appears from the affidavit of service that the respondent no.4 has been served. However, nobody appears on behalf of the respondent no.4. 4. Learned Advocate representing the petitioner submits that he is not praying for any order which will adversely affect the respondent no.4. He further submits that the petitioner had engaged the services of the respondent no.4 to provide caretaking services at 308 ATM sites in the Kolkata zone through its Sub-Contractors, deploying 625 personnel. Thereafter, due to alleged non-payment of wages and statutory dues by the respondent no.4 to the caretakers deployed at the aforesaid ATM sites, the Union of such caretakers raised a dispute before the
2 Labour Commissioner’s Office, Kolkata. Subsequently, conciliation proceedings were initiated in August, 2021 under Section 4 of the Industrial Disputes Act, 1947. It is submitted that till date, such proceedings have not yet been concluded. 5. Consequently, learned Advocate representing the petitioner submits that an order may be passed directing expeditious disposal of such conciliation proceedings. 6. Learned Advocate representing the Union of India does not oppose such prayer. 7. Accordingly, the respondent no.3, i.e., the Deputy Chief Labour Commissioner (Central) Kolkata, is directed to dispose of the aforesaid conciliation proceedings, being Nos. 5/(04)/2023.E.Dy. CLC(C) – (regarding illegal and forceful retrenchments of caretakers by contractors deputed at 46 ATM sites located in the State of West Bengal), 5/(04)/2023.E.Dy.CLC(C) (Notice of Strike), 5/(22)/2024 E.Dy.CLC(C) (Industrial Dispute between the Management of Bank of Baroda and their Contractors) and
5(21)/2024.E.(CLC(C) (Industrial Dispute between the Management of Bank of Baroda and their Contractors), as expeditiously as possible and preferably by December 31, 2026, in accordance with law. 3
8. The petitioner is directed to communicate a copy of this order to the respondent no.3 within a period of one week from today. 9. Since no affidavit-in-opposition has been called for, the allegations made in the writ petition are deemed not to have been admitted by the respondents. 10.
The writ petition being WPA/29289/2025 is accordingly disposed of. There will be no order as to costs. 11. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. 12.
